Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1. Sweepstakes Period: Sweepstakes begins at 8:00AM (CST) on February 15, 2009 and ends at 11:59PM (CST) on May 1, 2009.

3. Entry: Participants may win by signing up at www.organicearthday.org. One (1) entry per participant. As a condition of entry, entrants agree to be bound by these Official Rules and the decisions of Sponsor. Except where prohibited by law, by entering this Sweepstakes, you consent to (i) the use of your name, voice, picture, likeness and biographical data and/or any other information contained in your entry on and in connection with the campaign and in advertising, promotional and marketing materials by Sponsor and the Sponsor Affiliates worldwide in all media now known or hereafter discovered (including Sponsor’s and Sponsor Affiliates’ web sites) in perpetuity without additional compensation, notice, approval or review and (ii) the modification, editing, adaptation, electronic alteration, use, assignment and/or disposal of online entries however it sees fit and for any purpose without any notice or compensation to you or any third parties. By entering this Sweepstakes, you agree to waive any right to claim ambiguity with these Official Rules. You acknowledge that if you are chosen as a winner, certain of your personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, on a Winners’ List.
4. Winner Selection and Notification: Go Organic! for Earth Day will choose winners at random. Winners will be contacted by both email and telephone. If a potential winner cannot be contacted, does not respond within two (2) days from the date the Sponsor first tries to notify potential winner, and/or the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the Sweepstakes or to receive the prize. An alternate Sweepstakes participant may be selected at random. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Sweepstakes, including without limitation, the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared the “winner” of the Sweepstakes. In the event of a dispute as to the identity of any winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at the time of entry.
5. Prize Description: The prize has an estimated value of $1,800.00 (one thousand, eight hundred dollars and zero cents). The winner will receive a variety of organic products once a month for one (1) year from the Sponsor Affiliates: R.W. Knudsen, Van’s, Santa Cruz Organic, Country Choice Organic,
6. Odds of winning: The odds of winning depend on the number of eligible entries received.
7. Winner List: The winner will be posted and can be viewed at www.organicearthday.org from May 20, 2009 to December 31, 2009.
8. No Prize Transfer or Substitution: No prize or any portion thereof is transferable or redeemable for cash or any other instrument of value. There will be not substitutions for this prize.
9. Limitation on Liability and Disclaimer: All entries must be completed in full in order to be eligible. Any attempted form of entry other than as described herein is void. No mechanical reproductions, alterations, or forged entries allowed. Incomplete, illegible, and corrupted entries are void. Sponsor reserves the right, in its sole discretion, to disqualify any individual (and his/her entry) who tampers with the entry process.
Sponsor and Sponsor Affiliates shall not be liable to any Winner or any other person for failure to supply a prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s sole control.
Any person who supplies false information, enters by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a prize will forfeit the prize won and may be prosecuted to the fullest extent of the law. Each Sweepstakes entrant further agrees to not knowingly damage or cause interruption of the Sweepstakes; prevent others from using the Sweepstakes; or obtain or modify another user's account information without such user’s consent.
CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL AND/OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY SWEEPSTAKES ENTRANT MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor and Sponsor Affiliates are not responsible for lost, late, incomplete, destroyed, forged, damaged, tampered with, mass machine generated, unintelligible, incomprehensible and misdirected entries, otherwise not in compliance with these Official Rules or mail related to or resulting from participation in the Sweepstakes. Sponsor and Sponsor Affiliates are also not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions which may limit an entrant’s ability to participate in the Sweepstakes or damage to user’s system as a result of participation in the Sweepstakes or downloading any information necessary to participate in the Sweepstakes. Sponsor reserves the right in its sole discretion to cancel or modify the Sweepstakes if the Sweepstakes is not capable of running as planned, including, without limitation, any computer virus, malfunction, tampering, unauthorized intervention, fraud, technical failure or other cause beyond its control which corrupts, threatens or adversely affects the administration, security, fairness, integrity or proper operation of the Sweepstakes or cancellation of the campaign.
Neither Sponsor nor the Sponsor Affiliates make any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of any prize including, without limitation, quality, merchantability, or fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.
10. Consent and Release: Each sweepstakes participant agrees to release, discharge and hold harmless Sponsor and Sponsor Affiliates from and against any and all liabilities, claims, demands, losses, damages or actions of any kind whatsoever (including, without limitation, bodily injury, personal injury, death, disability and property damage), costs and expenses (including, without limitation, Attorneys’ fees, court costs. settlement and disbursements) directly or indirectly arising out of winner’s participation in the Sweepstakes, the receipt, ownership, redemption, use, misuse, loss or misdirection of the prize or any portion of the prize and hereby waives all rights to claim punitive, incidental and consequential damages.
11. Applicable Laws and Jurisdiction: This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of
